  1. REASON: The proposal fails to accord with Schedule 2, Part 20, Class AB.1(k), and Class AB.1(l) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), as the submitted details (plans, elevations and sections) fail to accurately depict the existing building, having omitted the in-situ plant on the rear elevation, and are considered inconsistent. The Local Planning Authority therefore refuses the application as the developer has provided insufficient information to enable the authority to establish whether the proposed development complies with, any conditions, limitations or restrictions specified within the Schedule 2, Part 20, Class AB.(B)(3) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).

  3. REASON: The proposal fails to accord with Schedule 2, Part 20, Class AB.2(1)(f) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). The applicant has failed to demonstrate that all habitable rooms to Studio Flat 02 and Studio Flat 05 would be provided with adequate natural light as the provision of windows in a side elevation is not possible under condition (3) of Class AB.2. This is contrary to the NPPF, the GPDO and the Local Plan Development Framework policies insofar as they are material considerations relevant to the prior approval matters.
  4. REASON: The proposed fails to accord with Schedule 2, Part 20, Class AB.2(1)(e) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). The proposed design of the addtional two floors fails to complement the existing building, the excessive height, addtional mass, poorly integrated fenestration pattern, lack of facade interest and staggered set back in an alternative modern design are not in keeping with the existing building or the wider terrace where it would become unduly prominent and out of place in this context. The proposal is therefore contrary to the NPPF, the GPDO and the Local Plan Development Framework policies insofar as they are material considerations relevant to the prior approval matters.
  5. REASON: The proposal fails to accord with Schedule 2, Part 20, Class AB.2 Condition 3 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), as the submitted details (plans, elevations and sections) include the installation of side facing windows. The Local Planning Authority therefore refuses the application as the development does not comply with this requirement as specified within the Schedule 2, Part 20, Class AB.2 Condition 3 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
  6. REASON: The proposal fails to accord with Schedule 2, Part 20, Class AB.2(1)(g) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). The applicant has failed to demonstrate that the proposed roof terrace would not give rise to unacceptable levels of overlooking leading to a loss of privacy for the residential occupiers of 136-138 Seven Sisters Road. Furthermore, the proposed siting, scale, height and mass of the development would lead to an unacceptable sense of enclosure and loss of outlook to neighbouring residents. This is contrary to the NPPF, the GPDO and the Local Plan Development Framework policies insofar as they are material considerations relevant to the prior approval matters.
