CAR FREE DEVELOPMENT: All future occupiers of the residential units hereby approved shall not be eligible to obtain an on street residents parking permit except: i) In the case of disabled persons; ii) In the case of units designated in this planning permission as 'non car free'; or iii) In the case of the resident who is an existing holder of a residents parking permit issued by the London Borough of Islington and has held the permit for a period of at least one year. REASON: To ensure that the development remains car free in accordance with policy T6 of the London Plan 2021 and policy T3 of the Islington Local Plan: Strategic and Development Management Policies 2023.
SOUND INSULATION: Prior to occupation of the residential dwellings, full particulars and details of a scheme for sound insulation between the proposed residential use and gym use of the building shall be submitted to and approved in writing by the Local Planning Authority. The sound insulation and noise control measures shall be carried out strictly in accordance with the details so approved, shall be implemented prior to the first occupation of the development hereby approved, shall be maintained as such thereafter and no change therefrom shall take place without the prior written consent of the Local Planning Authority. Following installation of the sound insulation details and noise control measures stated above, a report is to be commissioned by the applicant, using an appropriately experienced & competent person, to verify the sound insulation performance. The report shall include site measurements of the noise from gym activities and amplified music. REASON: In the interests of protecting the amenity of future residents of the development and to comply with Class MA.2 (2)(d) of the General Permitted Development Order (2015) as amended.
The applicant is reminded of the following conditions as set out in Schedule 2, Part 3, Class MA of The Town and Country Planning (General Permitted Development)(England) Order 2015 (as amended): - In accordance with Schedule 2, Part 3, Paragraph W. Sub-paragraph (12) the development must be carried out — (a) where prior approval is required, in accordance with the details approved by the local planning authority; (b) where prior approval is not required, or where sub-paragraph (11)(c) applies, in accordance with the details provided in the application referred to in sub-paragraph (1), unless the local planning authority and the developer agree otherwise in writing. - In accordance with Schedule 2, Part 3, Class MA. Sub-paragraph (5) development must be completed within a period of 3 years starting with the date prior approval date. - In accordance with Schedule 2, Part 3, Class MA. Sub-paragraph (6) any building permitted to be used as a dwellinghouse by virtue of Class MA is to remain in use as a dwellinghouse within the meaning of Class C3 of Schedule 1 to the Use Classes Order and for no other purpose, except to the extent that the other purpose is ancillary to the use as a dwellinghouse.
For the avoidance of doubt, any required changes to the external elevations of the building, including fenestration, will require full planning permission.
The applicant is advised of the need to fully comply with Building Regulations 2010 in relation to fire safety compliance and noise insulation requirements.
