  1. 3 YEAR CONSENT PERIOD FOR LBC: The works hereby permitted shall be begun not later than three years from the date of this consent. REASON: To comply with the provisions of Section 18(1)(a) of the Planning (Listed Buildings and Conservation Areas) Act 1990 as amended by the Planning and Compulsory Purchase Act 2004 (Chapter 5).
  2. ALL EXTERNAL AND INTERNAL WORKS TO MATCH (COMPLIANCE): All new external and internal works and finishes and works of making good to the retained fabric shall match the existing adjacent work with regard to the methods used and to material, colour, texture and profile. All such works and finishes shall be maintained as such thereafter. REASON: In order to safeguard the special architectural or historic interest of the heritage asset.
  3. PERSONAL CONSENT (COMPLIANCE): The consent for the following details is hereby granted for the benefit of the occupation of the premises by the applicant Mrs Anneka Swapna Madlani only. Within 6 months of this occupation ceasing the following works shall be reversed and restored to their prior condition to the satisfaction of the Local Planning Authority: (i) the works to provide a second-floor jack and jill bathroom, including the opening through the spine wall and the provision of pocket doors (ii) the works to provide a first-floor rear bathroom and dressing room, including the opening through the spine wall and the provision of pocket doors (iii) the replacement of the lower ground floor front lightwell door and the storage of the existing door. REASON: To protect the special interest of the building included on the statutory list whilst recognising the special circumstances surrounding the proposal and the specific needs of Mrs Anneka Swapna Madlani.
  4. EXISTING FRONT LIGHTWELL DOOR (COMPLIANCE): Notwithstanding the plans hereby approved, the existing door serving the lower ground floor front lightwell shall be carefully removed, wrapped in protective materials, laid flat and stored within the rear second-floor bedroom in the void above the ensuite. The door shall be retained on site for the lifetime of the development unless otherwise agreed in writing by the Local Planning Authority. REASON; To safeguard and retain a historic architectural feature which contributes to the significance and character of the host building.
  5. SOLAR PANELS (DETAILS): Prior to its installation, full details of the proposed solar photovoltaic installation shall be submitted to and approved in writing by the Local Planning Authority. The details shall include: (a) the route and method of installation of all cabling associated with the solar panels; and (b) the location, dimensions and means of enclosure of any battery storage equipment. The development shall thereafter be carried out in accordance with the approved details and retained as such. REASON: To ensure that the development preserves the character and appearance of the building and to safeguard heritage significance.
  6. STRUCTURAL REPORT (DETAILS): Prior to the commencement of the relevant part of the works, a structural engineer's report shall be submitted to and approved in writing by the Local Planning Authority. The report shall assess and provide details of: (a) the structural implications of the proposed alterations to the existing rear outrigger extension; (b) whether underpinning is required in connection with these or any other proposed works; and (c) any structural interventions required at second-floor level arising from the proposed removal of part of the spine wall. The approved development shall be carried out in full accordance with the approved report and recommendations. REASON: To ensure the structural stability and integrity of the building is safeguarded.
  7. MATERIALS (DETAILS): Prior to the commencement of above-ground works, details and samples of all external materials associated with the remodelled rear outrigger extension and rear garden works shall be submitted to and approved in writing by the Local Planning Authority. The details shall include: a) specifications and samples of the proposed brickwork, including brick type, colour, texture, pointing and bond; and b) details, specifications and samples of all proposed hard surfacing and other external materials associated with the rear garden works. The development shall be carried out in accordance with the approved details. REASON: To ensure a high-quality appearance that preserves the character and significance of the host building and surrounding area.
  8. WINDOWS AND DOORS (DETAILS): Prior to the installation of any windows and doors to the rear elevation, detailed drawings and specifications of the proposed windows and doors, at a scale of not less than 1:20 (with section details at 1:5 where required), shall be submitted to and approved in writing by the Local Planning Authority. The details shall include materials, profiles, opening mechanisms, glazing, reveal depths and finishes. The windows and doors shall be installed in accordance with the approved details and retained thereafter. REASON: To ensure that the detailed design preserves the character and appearance of the building and the significance of any heritage assets.
  9. INFORMATIVE: This permission relates to the particular circumstances and access requirements of a resident. This case is not intended to and does not create a precedent where such circumstances do not apply.
  10. INFORMATIVE: This consent relates solely to listed building matters. Should it become necessary to make alterations to the consented scheme in order to comply with other legislation, such as Building Regulations, a further consent may be required. Such a consent should be sought and obtained prior to the relevant works being undertaken.
  11. INFORMATIVE: The applicant, their successors, and developer must ensure compliance with the conditions listed above. Some conditions may require the submission and approval of further information to the Local Planning Authority prior to the commencement of development, works, use or occupation.
  12. INFORMATIVE: If you are an agent, please ensure that a full copy of this decision is forwarded to your client. In particular, please advise your client of any conditions attached to the decision and the need for them to comply with those conditions. Failure to comply with a condition is a breach of planning control, which could lead to enforcement action being taken against your client.
  13. INFORMATIVE: Please note that an application for approval of details reserved by a condition will need to be made to the Local Planning Authority in respect of those conditions. You should allow up to eight weeks for a decision. Please ensure that you allow plenty of time for this process when planning the timetable for your project. Commencement in breach of a condition could lead to enforcement action.
