  1. REASON: The applicant has failed to demonstrate exceptional circumstances to justify the proposed provision of studio flats which are contrary to the council’s housing size priorities and housing need. The proposed development would also provide a poor standard of amenity to future occupiers of the studio units by reason of the failure to demonstrate that all habitable rooms would have sufficient access to natural light, outlook and ventilation, the lack of outdoor amenity space, the failure to demonstrate a satisfactory acoustic environment to future occupiers and the lack of step free access and demonstration that the flats can achieve Category M4(2) ‘Accessible and Adaptable’ standards. This is contrary to policies D6 and D13 of the London Plan (2021) and policies H1, H2, H4, H5 and DH5 of Islington's Strategic and Development Management Policies (2023).
  2. REASON: The proposed development would result in the unjustified loss of commercial floorspace within the designated Seven Sisters Road Local Shopping Area and Seven Sisters Road Priority Employment Location. Insufficient supporting marketing, vacancy, viability and supporting evidence have been submitted to justify this loss and to demonstrate that the retained Class E use would be viable, that the development would not compromise the wider function and vitality of the LSA and PEL, and that the change of use to Class C3 would comply with the agent-of-chang principle. This is contrary to policies B1, B3, R1, R4 and DH5 of Islington’s Strategic and Development Management Policies (2023).
  3. PLANNING OBLIGATIONS: Under the terms of Islington’s Strategic and Development Management Policies (2023), Islington’s Affordable Housing Small Sites SPD (2012), Islington’s Climate Action SPD (2025) and Islington’s Planning Obligations SPD (2025), the applicant has agreed to enter into a legal agreement under Section 106 of the Town and Country Planning Act 1990 to pay the London Borough of Islington's Affordable Housing Small Sites contribution of £100,000 (£50,000 per flat), a carbon-offset contribution of £2,000 (£1,000 per flat) and the code of construction practice monitoring fee of £700 (£350 per flat). However, as the application is not considered to be acceptable, no such legal agreement has been entered into at the time of decision. If planning consent is granted for this application following an appeal, this development will be liable to pay the above contributions.
  4.   5. REASON: The applicant has failed to provide sufficient information to demonstrate that the proposed development would satisfactorily address sustainable design and construction requirements. In particular, inadequate information has been submitted to demonstrate that the proposed residential units would be designed to minimise overheating risk in accordance with the cooling hierarchy, including evidence that the proposed natural ventilation strategy would provide effective mitigation. Insufficient information has also been provided regarding renewable energy infrastructure, water efficiency measures, sustainable drainage and biodiversity enhancements. Therefore, the proposal does not meet the requirements of policies S4, S6, S9 and G4 of Islington's Strategic and Development Management Policies (2023).
