The development hereby permitted shall be commenced before the expiration of THREE years from the date hereof. REASON: Imposed in accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990.
The development hereby permitted shall not be carried out otherwise than in conformity with the following submitted plans and details: - Proposed plans and elevations dwg no. 25-530-DWG002 rev D - Proposed access plan dwg no. 25-530 DWG020 rev B - Proposed access - sections dwg no. 25-530 DWG021 rev B - Block plan and location plan dwg no. 25-530-DWG003 rev B - Tree survey report Revision A 17.03.26 - Tree mitigation plan dwg no. WW-L03A REASON: For the avoidance of doubt.
Prior to the commencement of the access works hereby permitted, a Construction Traffic Management Plan shall be submitted to and approved in writing by the local planning authority. The CTMP shall include details of: - Pre-construction road condition established by a detailed survey for works within the highways; - Retained areas for vehicle parking, manoeuvring, loading and unloading for their specific purpose during the development; - Details of any proposed temporary access points for vehicles and pedestrians. The development shall thereafter take place in accordance with the approved details. Upon completion of works a further road condition survey shall be undertaken and submitted to the Local Planning Authority. In the event that the survey identifies deterioriation of the highway condition as a result of the development, a scheme of remedial works (including a timetable for implementation) shall be submitted to the Local Planning Authority for approval. Remedial works shall thereafter take place in accordance with the details and timetable approved. REASON: In the interests of highway safety in accordance with Policy 08 of the Lake District National Park Local Plan 2020-2035.
Prior to the commencement of development hereby approved involving the construction of any retaining wall(s) adjacent to or supporting the highway, full engineering details of the proposed retaining wall(s) shall be submitted to and approved in writing by the Local Planning Authority. The submitted details shall include: - Full structural design calculations and drawings; - Ground investigation reports sufficient to establish the geotechnical parameters required to inform the retaining wall design; - Construction methodology and sequencing, including temporary works, measures to safeguard the public highway, and details of any required monitoring during construction. The retaining wall(s) shall thereafter be constructed in accordance with the approved details. REASON: In the interests of highway safety in accordance with Policy 08 of the Lake District National Park Local Plan 2020-2035.
The trees on the site which are shown to be retained on the approved plans shall be protected during all site clearance, demolition and building works in accordance with the measures set out in the submitted arboricultural statement by Westwood Landscape Design Revision A 17.03.26 alongside the recommendations as set out in BS5837:2012. REASON: To safeguard the visual amenities of the area in accordance with Policies 05 and 06 of the Lake District National Park Local Plan 2020-2035.
Not later than 12 months from the substantial completion of the development, landscaping of the site shall be undertaken in accordance with the details of a scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. The said scheme shall include: - the existing trees and shrubs which have been agreed to be retained; - a specification for new planting (species, size, spacing and location); - areas for hard surfacing and the materials to be used; - other means of enclosure; - a method and programme for its implementation and the means to provide for its future maintenance. Any trees or plants which, within a period of five years thereafter, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar sizes and species unless the Local Planning Authority gives written consent to any variation. REASON: To safeguard the visual amenities of the area in accordance with Policies 05 and 06 of the Lake District National Park Local Plan 2020-2035.
Town and Country Planning (Development Management Procedure) (England) Order 2015 Article 35(2) statement. The Local Planning Authority have worked with the applicant in a positive and proactive manner by seeking solutions to problems arising in relation to dealing with the application by raising concerns regarding design and access, and accepting amended plans.
For the avoidance of doubt, the retaining wall(s) shall remain the sole responsibility of the property owner and shall not become a highway structure. All future inspection, maintenance, repair, and associated liability shall rest entirely with the property owner. The owner is advised that failure to maintain the retaining wall(s) in a safe condition may result in enforcement action by the Local Highway Authority where the stability or safety of the highway is affected.
