Planning conditions
  1. The development hereby permitted shall be commenced before the expiration of THREE years from the date hereof. REASON: Imposed in accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990.
  2. The development hereby permitted shall not be carried out otherwise than in conformity with the following submitted plans and details: - Preliminary Roost Assessment - Heritage, Design and Access Statement - Arboricultural Survey, Impact Assessment and Tree Protection - Proposed Site Plan dwg no. P-06 rev F - Proposed Floorplan dwg no. P-03 rev C - Proposed Elevations dwg no. P-04 rev A - Location Plan dwg no. P-07 rev E REASON: For the avoidance of doubt.
  3. Town and Country Planning (Development Management Procedure) (England) Order 2015 Article 35(2) statement The Local Planning Authority did not identify problems arising in relation to dealing with the application.
  4. INFORMATIVE This accommodation has been approved as ancillary accommodation to the main house and must be used for this purpose only. The accommodation is part of a single planning unit together with the main house. Using the accommodation separately from the main house would amount to a material change of use that requires planning permission. For example a separate use could include use as a holiday let or occupation as a self-contained house. If a material change of use takes place without planning permission the use will be unauthorised and at risk of formal action. If an enforcement notice needs to be issued it would be served on everyone with an interest in the land. This would include any mortgagee. In assessing whether to take further action we can consider whether intentional unauthorised development has taken place.   5. Details of any external lighting shall be submitted to, and agreed in writing by, the Local Planning Authority prior to installation. Such lighting shall be maintained in accordance with the approved details thereafter. REASON: In order to minimise the effects of external lighting upon the special qualities of the Lake District National Park, including the tranquillity and intrinsically dark landscape of the open countryside in accordance with Policies 05 and 06 of the Lake District National Park Local Plan 2020-2035.
  6. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development)(England) Order 2015 (or any Order revoking and re-enacting that Order with or without modification), no alterations or extensions shall be undertaken to the building the subject of this permission without application to and the grant of planning permission by, the Local Planning Authority. REASON: The Local Planning Authority considers that such development should be subject to formal control in order to safeguard the character and appearance of the area in accordance with Policies 05 and 06 of the Lake District National Park Local Plan 2020-2035.
