Planning conditions
  1. The development hereby approved shall be commenced before the expiration of five years from the date of this permission. REASON: To comply with the requirements of Sections 91 to 93 of the Town and Country Planning Act, 1990.
  2.   3. The occupation of the dwelling shall be limited to a person solely or mainly employed or last employed in the locality in agriculture or forestry or a widow or widower of such a person and to any resident dependants. REASON: The Local Planning Authority's policy states that new houses in the open country shall not normally be permitted unless there is special need, having regard to agriculture or other rural interests and comply with Policy HN4 in the Flintshire Local Development Plan.
  4. No development on the construction of the external surfaces of the dwelling hereby permitted shall commence until details of the proposed materials have been submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved details. REASON: In the interests of the visual amenities of the locality and ensure compliance with Policies PC2 and PC3 of the Flintshire Local Development Plan.
  5. The proposed landcaping incorporating biodiversity net benefit measures shall be as shown on the Existing & Proposed Site Plans - Dwg 1 and Green Infrastructure Statement approved as part of this permission, and shall be completed to the written satisfaction of the Local Planning Authority within 6 months of the occupation of the dwelling. REASON: In the interest of maintaining and enhancing biodiversity in accordance with Local Develoment Plan Policy STR13 and Planning Policy Wales (PPW) - Edition 12.
  6. All trees and hedges to be retained as part of the development hereby permitted shall be protected during site clearance and construction work by 1 metre high fencing erected 1 metre outside the outermost limits of the branch spread, or in accordance with an alternative scheme agreed in writing by the Local Planning Authority; no construction materials or articles of any description shall be burnt or placed on the ground that lies between a tree trunk or hedgerow and such fencing, nor within these areas shall the existing ground level be raised or lowered or any trenches or pipe runs excavated, without prior written consent of the Local Planning Authority. REASON: In order to safeguard existing natural landscape features and ensure compliance with Policy PC2 of the FlintshireLocal Development Plan.
  7. The applicant is reminded that the development which is the subject of this planning permission will also require Sustainable Drainage Systems (SuDS) for surface water in accordance with the requirements of Schedule 3 to the Flood and Water Management Act 2010. From 7th January 2019, SuDS on new developments must be designed and built in accordance with the Statutory SuDS Standards published by the Welsh Ministers and SuDS Schemes must be approved by the local authority acting in its SAB role, before construction work begins. Furthermore, SuDS features serving more than one property will be subject to adoption by the SAB.   8. The applicant is advised that some public sewers and lateral drains may not be recorded on DCWW maps;some sewers were originally privately owned and were transferred into public ownership by nature of the Water Industry (Schemes for Adoption of Private Sewers) Regulations 2011. The presence of such assets may affect the proposal. In order to assist in dealing with the proposal the applicant may contact Dwr Cymru Welsh Water. Under the Water Industry Act 1991 Dwr Cymru Welsh Water has rights of access to its apparatus at all times. The applicant may also need to apply to Dwr Cymru / Welsh Water for any connection to the public sewer under S106 of the Water industry Act 1991. If the connection to the public sewer network is either via a lateral drain (i.e. a drain which extends beyond the connecting property boundary) or via a new sewer (i.e. serves more than one property), it is now a mandatory requirement to first enter into a Section 104 Adoption Agreement (Water Industry Act 1991). The design of the sewers and lateral drains must also conform to the Welsh Ministers Standards for Gravity Foul Sewers and Lateral Drains, and conform with the publication "Sewers for Adoption"- 7th Edition. Further information can be obtained via the Developer Services pages of www.dwrcymru.com In accordance with Planning Policy Wales (Edition 12) and Technical Advice Note 12 (Design), the applicant is advised to take a sustainable approach in considering water supply in new development proposals, including utilising approaches that improve water efficiency and reduce water consumption. it is recommended that the applicant liaises with the relevant Local Authority Building Control department to discuss their water efficiency requirements.
