  1. Foul flows can be accommodated within the immediate public sewerage system and the Waste water Treatment Works has a phosphorous consent limit in place, however the Waste water Treatment Works is currently failing to complly with the 95% quartile for its flow passed forward (FPF) performance and would therefore lead to an adverse effect on the Special Area of Conservation (SAC) contrary to Policy EN15 of the Flintshire Local Development Plan.
  2. In the opinion of the Local Planning Authority insufficient information has been submitted to demonstrate that the site has been adequately assessed for land contamination and potential legacy issues that may exist at the site. In addition, the application does not appear to demonstrate that the risk of pollution to controlled waters is acceptable. As such the proposal is contrary to policy EN16 of the Flintshire Local Development Plan.
  3. In the opinion of the Local Planning Authority the proposal has not demonstrated that potential land stability issues as a result of the sites mining legacy has been appropriately dealt with. In the absence of this information it is considered that the proposal is contrary to policy EN17 of the Flintshire Local Development Plan.
