Planning conditions
  1. Approval of the details of the siting, design and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the local planning authority in writing before any development is commenced. REASON: The application is submitted in outline only and no details of the development have been submitted.
  2. The development shall be carried out in accordance with the following approved plans and documents: Application form received 15.07.24 Location plan received 15.07.24 Copy of Decision Notice 058979 received 15.07.24 Copy of Decision Notcie 062023 received 15.07.24 REASON: To ensure that the development is carried out in accordance with the approved details.
  3. The applicant will be required to enter in to a Section 278 Agreement to construct the new access. REASON: To maintain the safety and free flow of trunk road traffic and so comply with policy PC5 of the Adopted Flintshire Local Development Plan.
  4. The development hereby permitted shall be begun either before the expiration of 12 months from the date of this permission, or before the expiration of three years from the date of approval of the last of the reserved matters, whichever is the latter. REASON: To comply with Sections 91 to 93 of the Town and Country Planning Act, 1990 (as subsequently amended).
  5. Condition discharged under reference DET/0416/25
  6. Adequate facilities shall be provided and retained within the site for the parking and turning of vehicles. Such facilities being completed prior to the proposed development being brought into use. REASON: To ensure that adequate parking and manoeuvring space is provided to serve the proposed development and to avoid the necessity for reversing movements into or from the Trunk Road in the interest of highway safety and maintaining the free flow of traffic on the adjoining highway in accordance with Policy PC5 of the Flintshire Local Development Plan
  7. The proposed turning and parking areas shall be completed to the satisfaction of the Local Planning Authority before the proposed development is brought into use. REASON: In order to preserve the safety and free flow of traffic on the adjacent Trunk Road and in accordance with Policy PC5 of the Flintshire Local Development Plan.

  9. Foul water and surface water discharges shall be drained separately from the site. REASON: To protect the integrity of the public sewerage system, in accordance with Policy EN15 of the Flintshire Local Development Plan.
  10. .No surface water shall be allowed to connect, either directly or indirectly, to the public sewerage system unless otherwise approved in writing by the Local Planning Authority. REASON: To prevent hydraulic overloading of the public sewerage system, to protect the health and safety of existing residents and ensure no detriment to the environment, in accordance with Policy EN15 of the Flintshire Local Development Plan.
  11. Land drainage run-off shall not be permitted to discharge, either directly or indirectly, into the public sewerage system. REASON: To prevent hydraulic overload of the public sewerage system and pollution of the environment, in accordance with Policy EN15 of the Flintshire Local Development Plan.
  12. The proposed development site is crossed by a public sewer with the approximate position being marked on the attached Statutory Public Sewer Record. Under the Water Industry Act 1991 Dwr Cymru Welsh Water has rights of access to its apparatus at all times. No part of the building will be permitted within 3 metres either side of the centreline of the public sewer. REASON: To protect the integrity of the public sewer and avoid damage thereto, in accordance with Policy EN15 of the Flintshire Local Development Plan.
  13. The applicant may need to apply to Dwr Cymru / Welsh Water for any connection to the public sewer under S106 of the Water industry Act 1991. If the connection to the public sewer network is either via a lateral drain (i.e. a drain which extends beyond the connecting property boundary) or via a new sewer (i.e. serves more than one property), it is a mandatory requirement to first enter into a Section 104 Adoption Agreement (Water Industry Act 1991). The design of the sewers and lateral drains must also conform to the Welsh Ministers Standards for Gravity Foul Sewers and Lateral Drains, and conform with the publication "Sewers for Adoption"- 7th Edition. Further information can be obtained via the Developer Services pages of www.dwrcymru.com. The applicant is also advised that some public sewers and lateral drains may not be recorded on our maps of public sewers because they were originally privately owned and were transferred into public ownership by nature of the Water Industry (Schemes for Adoption of Private Sewers) Regulations 2011. The presence of such assets may affect the proposal. In order to assist us in dealing with the proposal the applicant may contact Dwr Cymru Welsh Water. Under the Water Industry Act 1991 Dwr Cymru Welsh Water has rights of access to its apparatus at all times. In accordance with Planning Policy Wales (Edition 12) and Technical Advice Note 12 (Design), the applicant is advised to take a sustainable approach in considering water supply in new development proposals, including utilising approaches that improve water efficiency and reduce water consumption. We would recommend that the applicant liaises with the relevant Local Authority Building Control department to discuss their water efficiency requirements. As of 7th January 2019, this proposed development may be subject to Schedule 3 of the Flood and Water Management Act 2010. In the event this proposed development amounts to a total impermeable area of 100sqm or more, approval of Sustainable Drainage Systems (SuDS) features will be required in accordance with the 'Statutory standards for sustainable drainage systems – designing, constructing, operating and maintaining surface water drainage systems'. It would therefore be recommended that the developer engage in consultation with Flintshire Council, as the determining SuDS Approval Body (SAB), in relation to their proposals for SuDS features. Please note, Dwr Cymru Welsh Water is a statutory consultee to the SAB application process and will provide comments to any SuDS proposals by response to SAB consultation
  14. The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to The Coal Authority on 0845 762 6848.
