The application site is located within a Tier 5 Undefined Village location, outside of a recognised settlement boundary and where market dwellings will only be supported where they are essential to delivering affordable housing. The provision of a single market dwelling is therefore considered contrary to policies STR2, PC1 and HN4 of the Flintshire Local Development Plan.
It is considered that the design and materials for the proposed new dwelling would have a significant detrimental impact upon the character and appearance of the protected landscape contrary to Policies PC2, PC3 and EN8 of the Flintshire Local Development Plan.
The application site is located in an area which has been mined extensively for lead and other metals in the past. The application as submitted fails to demonstrate that the erection of a dwelling on the site is capable of being achieved without serious risk to public health with regards to potential of contaminated land or residential amenity. The proposal therefore fails to accord with Policies EN16 and EN18 of the Flintshire Local Development Plan.
The application site is located within the Halkyn Common and Holywell SSSI and therefore the proposed erection of a bungalow at this location would represent inappropriate development and is considered contrary to Policy EN4 of the Local Development Plan and PPW.
In the opinion of the Local Planning Authority it has not been demonstrated that the development would not lead to an increase in phosphate levels in the River Dee and Bala Lake SAC, with a resultant significant impact on the protected site. As such it is considered that the development is contrary to Policy EN15 of the Flintshire Local Development Plan as well as advice contained within Planning Policy Wales 12 regarding Water Quality and the protection of SACs, , and Welsh Government Circular 008/2018.
