Planning conditions
  1. The development hereby approved shall be commenced before the expiration of five years from the date of this permission. REASON: To comply with the requirements of Sections 91 to 93 of the Town and Country Planning Act, 1990.
  2. The development shall be carried out in accordance with the following approved plans and documents: Application Form received 03/06/2026 Location Plan received 03/06/2026 Proposed Site Plan DWG No. 6 received 03/06/2026 Proposed Floor Plan DWG No. 3 received 03/06/2026 Proposed Elevations DWG No. 4 received 03/06/2026 Green Infrastructure Statement received 29/07/2026 REASON: To ensure that the development is carried out in accordance with the approved details.
  3. NOTE TO APPLICANT The development is in close proximity to an overhead power line. The applicant should contact SP Energy Networks to discuss diverting the directly affected assets https://www.spenergynetworks.co.uk/pages/diversion.aspx . The Electricity Safety, Quality and Continuity Regulations 2002 https://www.legislation.gov.uk/uksi/2002/2665/regulation/18 Section 18 states: the following (5) No overhead line shall, so far as is reasonably practicable, come so close to any building, tree or structure as to cause danger. (6) In this regulation the expression “ordinarily accessible” means the overhead line could be reached by hand if any scaffolding, ladder or other construction was erected or placed on, in, against or near to a building or structure. In the event planning permission is approved, the applicant must be made aware of the need to work safely around these assets or to divert them where necessary. There would need to be safe working during construction and post construction and unfettered long term access maintained.   4. The proposed development lies within an area that has been defined by The Coal Authority as containing potential hazards arising from former coal mining activity. These hazards can include: mine entries (shafts and adits); shallow coal workings; geological features (fissures and break lines); mine gas and previous surface mining sites. Although such hazards are seldom readily visible, they can often be present and problems can occur in the future, particularly as a result of development taking place. It is recommended that information outlining how the former mining activities affect the proposed development, along with any mitigation measures required (for example the need for gas protection measures within the foundations), be submitted alongside any subsequent application for Building Regulations approval (if relevant). Your attention is drawn to the Coal Authority policy in relation to new development and mine entries available at www.coal.decc.gov.uk Any intrusive activities which disturb or enter any coal seams, coal mine workings or coal mine entries (shafts and adits) requires the prior written permission of The Coal Authority. Such activities could include site investigation boreholes, digging of foundations, piling activities, other ground works and any subsequent treatment of coal mine workings and coal mine entries for ground stability purposes. Failure to obtain Coal Authority permission for such activities is trespass, with the potential for court action.
