- The building the subject of this applicaion is not suitable an employment generatng use, or a subordinate part of a scheme fo rbusiness re-use or is proposed to meet an affordable local housing need. In addition the building does not possess any traditional character worthy of retention. The proposal is therefore contrary to criteria a and c and ii) of Policy HN4- B of the Flintshire Local Development Plan and Supplementary Planning Guidance Note 5 - Conversion of Rural Buildings.
- In the absence of a Contaminated Land Survey and Ecological Appraisal , it is not possible to assess the impact of development on the health and safety of the occupiers of the proposed dwelling or on ecological species and their habitats. The proposal is therefore contrary to Technical Advice Note 5 - Nature Conservation and Planning, Planning Policy Wales (PPW) - Edition 12 and Policies PC2, EN6 and EN16 of the Flintshire Local Development Plan.
- To grant planning permission would be contrary to the advice received from Natural Resources Wales (NRW) andDwr Cymru Welsh Water who are currently undertaking a review of Water Company Discharge Permits and further data analysis for the River Dee Until this has been concluded it is not possible to confirm that the discharge of further phosphouros into the Rhosesmor Waste Water Treatment Works would be acceptable . As a result the proposal is contrary to Technical Aadvice Note (TAN) 15 - Development, Flooding and Coatal Erosion and Policies PC2 , EN15 and EN18 of the Flintshire Local Development Plan.
