Variation of condition 2 for the retrospective amendments to the approved scheme

1. The development hereby approved shall be commenced before the expiration of five years from the date of this permission. REASON: To comply with the requirements of Sections 91 to 93 of the Town and Country Planning Act, 1990.
2. 4. All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the substantial completion of the development, whichever is the sooner and any trees or plants which, within a period of 5 years of the time of planting die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the local planning authority gives written consent to any variation. REASON: To ensure that the approved landscaping scheme is implemented to the satisfaction of the local planning authority and comply with Policy PC2 in the Flintshire Local Development Plan.

8. The works associated with forming the means of site access shall be kerbed and completed to carriageway base course layer up to the internal tangent point of the entrance radii prior to the commencement of any other site building operations. REASON: To ensure the formation of a safe and satisfactory means of access to the site in the interests of maintaining highway safety and the free and safe movement of traffic on the adjoining highway in accordance with policies STR5 and PC5 in the Flintshire Local Development Plan
9. The proposed accesses from Gladstone Way and Ash Lane shall have minimum visibility splays of 2.4m x 43m in both directions measured along the nearside edge of the adjoining carriageway over land within the control of the Applicant and/or Highway Authority and within which there shall be no significant obstruction to visibility. REASON: To ensure that adequate visibility is provided and maintained during the site construction phase in accordance with policies STR5 and PC5 in the Flintshire Local Development Plan

13. The gradient of the adoptable highway from the edge of the existing carriageway and for a minimum distance of 10m shall be 1 in 24 and not exceed a maximum of 1 in 15 thereafter. 16. The works to provide the footway from the along the site’s frontage with Ash Lane shall be completed to the satisfaction of the Highway Authority prior to the first occupation of the development. REASON: To provide for and safeguard pedestrian movement and to assist in maintaining visibility sightlines in accordance with policies STR5 and PC5 in the Flintshire Local Development Plan.

22. No development shall commence until a point of connection on the public sewerage system as has been identified by a hydraulic modelling assessment, which shall be first submitted to and approved by the local planning authority. Thereafter the connection shall be made in accordance with the recommended connection option following the implementation of any necessary improvements to the sewerage system, as may be identified by the hydraulic modelling assessment REASON: In order to protect the integrity of the sewerage system, in accordance with policy EN15 of the Flintshire Local Development Plan. 23. No development shall take place within the application area until the implementation of a programme of archaeological excavation work in accordance with the approved written scheme of investigation (ref. PD24_031) The archaeological programme of work will be undertaken and completed in accordance with the relevant Standards and Guidance provided by the Chartered Institute for Archaeologists. A copy of the resulting report should be submitted to the Planning Authority and the Planning Archaeologist, (Heneb: Clwyd Powys Archaeology, The Offices, Coed y Dinas, Welshpool, SY21 8RP). After approval by the Planning Authority a report must be submitted and approved for inclusion in the Heneb: Clwyd Powys Archaeology Historic Environment Record. The full digital archive must also be submitted and approved for inclusion within the National Monuments Record, RCAHMW or the Archaeology Data Service, ADS. ) REASON: To secure preservation by record of all archaeological remains which will be impacted by the development. 24. No development shall commence until remedial/mitigation measures to address land instability arising from coal mining legacy have been implemented on site in full in order to ensure that the site is safe and stable for the development proposed. REASON: To ensure that potential risk to the proposed development as a result of recorded mine entries (shafts) and shallow coal mine workings is identified and appropriate remedial measures are undertaken prior to the commencement of development to ensure a safe development, in accordance with policy EN17 of the Flintshire Local Development Plan.
25. Prior to the occupation of the development, or it being taken into beneficial use, a signed statement or declaration prepared by a suitably competent person confirming that the site is, or has been made, safe and stable for the approved development shall be submitted to the Local Planning Authority for approval in writing. This document shall confirm the methods and findings of the intrusive site investigations and the completion of any remedial works and/or mitigation necessary to address the risks posed by past coal mining activity. REASON: To ensure that potential risk to the proposed development as a result of recorded mine entries (shafts) and shallow coal mine workings is identified and appropriate remedial measures are undertaken prior to the commencement of development to ensure a safe development, in accordance
