Planning conditions
  1. In the opinion of the Local Planning Authority the proposal, due to its scale, massing and siting close to shared boundaries, would result in a detrimental impact upon neighbouring residential amenity . It is therefore considered that the current proposal would conflict with policies PC2 and PC3 in the Flintshire Local Development Plan.
  2. The application site lies within the catchment of the River Dee and Bala Lake Special Area of Conservation (SAC). Insufficient information has been submitted to enable the Local Planning Authority, having regard to the advice of Natural Resources Wales, to undertake an Appropriate Assessment and conclude that the proposal would not have an adverse effect on the integrity of the SAC. Applying the precautionary principle, the Local Planning Authority cannot ascertain that the proposal would avoid adverse effects on the integrity of the European Site. The proposal is therefore contrary to Policies PC2 and EN6 of the Flintshire Local Development Plan.
  3. In the absence of a Preliminary Ecological Appraisal, the Local Planning Authority has been unable to assess the likely effects of the proposal on habitats, protected species and biodiversity interests and cannot conclude that the proposal complies with the biodiversity requirements of Policies PC3 and EN6 of the Flintshire Local Development Plan.
  4. Insufficent information has been submitted with regard to contaminated land. Applications with the potential for contaminates on site must be supported by information that demonstrates that appropriate investigation has been undertaken to determine the actual or potential presence of landfill gases, leachates and/or other pollutants on the land to be developed. Without this information it is considered that the proposal currently does not comply with policies PC2 and EN16
  5. In the opinion of the Local Planning Authority the access arrangements do not appear to be appropriate or demonstrate that safe access and egress of the site is possible. As such it is not considered that the proposal would be in accordance with policies STR5 and PC5 of the Flintshire Local Development Plan.
