No surface water and/or land drainage shall be allowed to connect directly or indirectly with the public sewerage network. REASON: To prevent hydraulic overloading of the public sewerage system, to protect the health and safety of existing residents and ensure no pollution of or detriment to the environment.
Advisory Notes The applicant may need to apply to Dwr Cymru / Welsh Water for any connection to the public sewer under S106 of the Water industry Act 1991. If the connection to the public sewer network is either via a lateral drain (i.e. a drain which extends beyond the connecting property boundary) or via a new sewer (i.e. serves more than one property), it is a mandatory requirement to first enter into a Section 104 Adoption Agreement (Water Industry Act 1991). The design of the sewers and lateral drains must also conform to the Welsh Ministers Standards for Gravity Foul Sewers and Lateral Drains, and conform with the publication "Sewers for Adoption"- 7th Edition. Further information can be obtained via the Developer Services pages of www.dwrcymru.com The applicant is also advised that some public sewers and lateral drains may not be recorded on our maps of public sewers because they were originally privately owned and were transferred into public ownership by nature of the Water Industry (Schemes for Adoption of Private Sewers) Regulations 2011. The presence of such assets may affect the proposal. In order to assist us in dealing with the proposal the applicant may contact Dwr Cymru Welsh Water. Under the Water Industry Act 1991 Dwr Cymru Welsh Water has rights of access to its apparatus at all times. In accordance with Planning Policy Wales (Edition 12) and Technical Advice Note 12 (Design), the applicant is advised to take a sustainable approach in considering water supply in new development proposals, including utilising approaches that improve water efficiency and reduce water consumption. We would recommend that the applicant liaises with the relevant Local Authority Building Control department to discuss their water efficiency requirements.
No development shall commence until SAB approval has been obtained for the surface water drainage system. REASON: To reduce flood risk both on and off site and to ensure that surface water can be appropriately drained for the lifetime of the proposed development.
SAB Informative: Developments of more than 1 house or of 100m2 or more of construction area must also seek SAB approval alongside planning approval. You will not be allowed to start construction until the two permissions are both granted. The SAB approval process operates independently of the planning process. It is important to avoid situations where a scheme is granted planning permission but fails to secure SAB approval. To mitigate this risk, it is recommended that planning and SAB requirements are considered concurrently, and that relevant information is submitted in parallel to both authorities. This can be best achieved by submitting simultaneous applications for planning permission and SAB approval. Where this is not feasible, a Drainage Statement should accompany the planning application. This statement should clearly demonstrate how Sustainable Drainage Systems (SuDS) will be integrated into the scheme, thereby giving confidence that the scheme is likely to comply with SAB requirements. Under Schedule 3 of the Flood and Water Management Act (FWMA) 2010, all new developments must ensure that surface water drainage complies with mandatory National SuDS Standards. Further information can be found at: https://gov.wales/topics/environmentcountryside/epq/flooding/drainage/?lang=en TAN 15 aligns with Schedule 3 of the Flood and Water Management Act 2010, which mandates that all new developments use SuDS designed to national standards in Wales.
Informative: Any development (temporary or permanent) within 8 metres of a watercourse will require separate Land Drainage Consent from the LLFA. More information is available at: https://www.flintshire.gov.uk/en/Resident/Planning/Land-Drainage-Consents.aspx Please note: Any works carried out without prior consent will be subject to removal, and the watercourse must be reinstated to its original condition. Retrospective consent is not permitted.
The drain which runs along the adjacent track and hedgerow is classified as an ordinary watercourse. More information on watercourses is available at: https://naturalresources.wales/flooding/owning-a-watercourse/?lang=en o An 8m easement along the watercourse corridor must be maintained to ensure access for maintenance of the watercourse o No development—including building foundations, underground tanks, or other structures—should be located within this easement. o A reduction in the required easement may be considered, subject to a successful land drainage consent application. This requirement is intended to minimise flood risk both on and off site and to ensure appropriate access for long-term maintenance by the riparian owner.
The proposed agricultural building shall be used only for purposes of agricultural storage for machinery, fodder, implements and grain and as such and no trade or business shall be carried out therefrom. REASON: In the interests of the residential and general amenities of the area and comply with Policies PC2 and EN18 of the Flintshire Local Development Plan.
