  3. LLFA
  4. If, during construction, it is identified that works are located within the protection zone of the strategic water main crossing the site, works shall cease until a method statement and risk assessment for the protection of the structural condition of the main shall be submitted to and approved in writing by the Local Planning Authority. The approved protection measures shall be implemented in full before any other development hereby permitted shall re- commence, and shall be retained at all times for the duration of the approved operations including the restoration works. REASON: To ensure that the proposed development does not affect the integrity of the public water supply system in the interests of public health and safety.
  5. Not later than 18 months following the commencement of the development hereby permitted, a scheme of biodiversity enhancement measures shall be submitted for the approval in writing by the local planning authority and be implemented within 3 months of approval. The scheme shall be based on the principles of the Net Benefit for Biodiversity Report (Ref - 0487-WSP-XX-RP-ENV-00120-P01) and shall be retained thereafter. REASON: To ensure the development secures a net benefit for biodiversity and promotes the resilience of ecosystems through the implementation and retention of appropriate biodiversity enhancement measures, in accordance with Policy EN6 of the Flintshire Local Development Plan and Planning Policy Wales (Edition 12), Chapter 6.
  6. Following completion of the remediation works a verification report demonstrating completion of the works set out in the approved remediation strategy and the effectiveness of the remediation shall be submitted to and approved, in writing, by the Local Planning Authority. The report shall include results of sampling and monitoring carried out in accordance with the approved verification plan to demonstrate that the site remediation criteria have been met. It shall also include any plan (a “long-term monitoring and maintenance plan”) for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action, as identified in the verification plan, and for the reporting of this to the Local Planning Authority. REASON: To ensure that the remediation works have been satisfactorily completed and verified, and that any remaining risks associated with land contamination are appropriately monitored and managed in the interests of protecting human health, controlled waters and the environment, in accordance with Policy EN16 of the Flintshire Local Development Plan 2015–2030 and Planning Policy Wales (Edition 12).
  7. The treatment and disposal of contaminated soils and groundwater is regulated by waste legislation and requires an environmental permit. Excavated materials that are recovered via a treatment operation can be re-used on-site under the CL:AIRE Definition of Waste: Development Industry Code of Practice. This voluntary Code of Practice provides a framework for determining whether excavated material arising from site during remediation and/or land development works are waste. Developers should ensure that all contaminated materials are adequately characterised both chemically and physically, and that the permitting status of any proposed on site operations are clear. If in doubt, Natural Resources Wales should be contacted for advice at an early stage to avoid any delays.
  8. The applicant is advised that some public sewers and lateral drains may not be recorded on our maps; some sewers were originally privately owned and were transferred into public ownership by nature of the Water Industry (Schemes for Adoption of Private Sewers) Regulations 2011. The presence of such assets may affect the proposal. In order to assist us in dealing with the proposal the applicant may contact Dwr Cymru Welsh Water. Under the Water Industry Act 1991 Dwr Cymru Welsh Water has rights of access to its apparatus at all times. The applicant may also need to apply to Dwr Cymru / Welsh Water for any connection to the public sewer under S106 of the Water industry Act 1991. If the connection to the public sewer network is either via a lateral drain (i.e. a drain which extends beyond the connecting property boundary) or via a new sewer (i.e. serves more than one property), it is now a mandatory requirement to first enter into a Section 104 Adoption Agreement (Water Industry Act 1991). The design of the sewers and lateral drains must also conform to the Welsh Ministers Standards for Gravity Foul Sewers and Lateral Drains, and conform with the publication "Sewers for Adoption"- 7th Edition. Further information can be obtained via the Developer Services pages of www.dwrcymru.com. In accordance with Planning Policy Wales (Edition 12) and Technical Advice Note 12 (Design), the applicant is advised to take a sustainable approach in considering water supply in new development proposals, including utilising approaches that improve water efficiency and reduce water consumption. We would recommend that the applicant liaises with the relevant Local Authority Building Control department to discuss their water efficiency requirements. If the development will give rise to a new discharge (or alter an existing discharge) of trade effluent, directly or indirectly to the public sewerage system, then a Discharge Consent under Section 118 of the Water Industry Act 1991 is required from Dwr Cymru / Welsh Water. Please note that the issuing of a Discharge Consent is independent of the planning process and a consent may be refused although planning permission is granted.   9.   10. If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority for, an amendment to the remediation strategy detailing how this unsuspected contamination shall be dealt with. REASON: To ensure that any previously unidentified contamination encountered during the development is appropriately investigated, assessed and remediated, in the interests of protecting human health, controlled waters and the wider environment, and to ensure that the development does not proceed without appropriate remediation or precautionary measures, in accordance with Policy EN16 of the Flintshire Local Development Plan and Planning Policy Wales (Edition 12).
  11. No infiltration of surface water drainage into the ground is permitted other than with the express written consent of the Local Planning Authority, which may be given for those parts of the site where it has been demonstrated that there is no resultant unacceptable risk to controlled waters. The development shall be carried out in accordance with the approval details. Reason: To prevent the mobilisation of contaminants and the pollution of controlled waters through infiltration of surface water drainage, and to ensure that any infiltration drainage is only permitted where it has been demonstrated that there would be no unacceptable risk to water resources, in accordance with Policy EN15 of the Flintshire Local Development Plan 2015–2030 and Planning Policy Wales (Edition 12).
