Planning conditions
  1. The proposed development site is located in an area where coal has been extensively mined in the past and, according to historical maps and maps held by the Mining Remediation Authority, coal mining related features including a colliery and mine shaftss are recorded adjacent to or in very close proximity to the site. The application lacks a land contamination assessment and a coal mine gas risk assessment and ground monitoring, which should have been undertaken over a suitable period of time and during worst-case conditions. The application is therefore contrary to Policies PC2, EN17 and EN18 of the Flintshire Local Development Plan.
  2. The application site is within the catchment of the River Dee Special Area of Conservation (SAC) and in the opinion of the Local Planning Authority insufficient information is available until Natural Resources Wales (NRW) have carried out a review into phosphates. The Local Planning Authority are unable to carry out a Habitats Regulation Assessment (HRA) in relation to phosphates at this time and without this the proposals would have an adverse effect on the SAC contrary to Policy EN6 of the Flintshire Local Development Plan.
  3. In the opinion of the Local Planning Authority amended plans and further information is required and without this the proposals would have an adverse effect on the highway contrary to Policy PC5 of the Flintshire Local Development Plan.
  4. In the opinion of the Local Planning Authority the application contains insufficient information relating to site levels to assess the impact of the development on the existing surrounding development and would adversely affect the living conditions of occupiers and the character and appearance of the area contrary to Policy PC2, PC3 of the Flintshire Local Development Plan.
