Modification of Planning Obligation under Section 75 of the Town and Country Planning (Scotland) Act 1997 attached to Planning Permission P/12/0124/PPP to the effect that:-1. the figure "�4,420" at Clause 1.11 is delete and the figure "�2,600" substituted therefor;2. the wording "a pro rata share of" where it appears in the third line of Clause 3.1.1 is delete;3. the wording "and �1,820 of which Payment together with a pro rata share of Indexation Figure 1, 2, 3, 4, 5 and 6 as applicable shall be applied only towards improvements to open space/play facilities in the local area of the Development" where they appear on the fifth, sixth and seventh lines of Clause 3.1.1 are delete;4. New definition clauses 1.16A, 1.16B and 1.16C respectively will be inserted immediately after Clause 1.16 as follows: 1.16A "Plan 2" means the plan marked plan 2 annexed and signed as relative hereto; 1.16B "Recreational Areas" means the areas shown coloured green and partly hatched, dark green, blue, pink and orange along with the informal path network indicated by black lines on Plan 2 all insofar as they lie within the Larger Subjects; 1.16C "Recreational Facilities" means the facilities on the Recreational Areas including equipped playpark area, informal path network, open grass areas, woodland areas, fishery, golfing and animal and livestock viewing and feeding areas all as shown on and with reference to the legend on Plan 2;5. A new Clause 3.1.2 will be inserted immediately after Clause 3.1.1 to read "The Landowner will have unrestricted access to the Recreational Areas and use of the Recreational Facilities free of charge at all times and in all time coming;" 6. A plan marked "plan 2 " as enclosed with this application will be added to the S75.
