- By reason of the applicants being unwilling or unable to enter into a Section 106 agreement to secure the affordability of the dwelling and restricting the occupancy of the dwelling to a person satisfying the local persons criteria in need of housing or agreeing to the payment of a commuted sum to provide affordable local occupancy housing elsewhere this application is in conflict with ELDP policies C, 9, G and 30 and Supplementary Planning Guidance 4.
