Tree Protection must be addressed as per the tree protection plans enclosed within the document. This condition may only be fully discharged upon completion of the proposed development, subject to evidence of satisfactory supervision and monitoring. Reason: to retain and protect the existing trees which form an important part of the amenity of the locality.
  22. With the exception of Phase 1a no excavation, demolition or development related works shall commence until evidence has been submitted and approved in writing by the Local Planning Authority to demonstrate that the tree protection measures have been installed, as detailed in the tree protection plan. Tree protection measures in Phase 1a shall be in accordance with the drawings P1388.PH.01 rev D “Phasing Plan” and MILL22453-04B “Tree Protection Fencing – Phase 1a” and the email from Rob Collett, Miller Homes to Chris Stringer, Tree Consultant, EBC dated 24.11.20 with attached Tree Protection Fencing schedule dated 20.11.20 showing photographs of the fencing and the locations the photographs were taken from demonstrating the installation of tree protection fencing in accordance with MIMLL22453-04B, as approved under DC/20/89308. Once approved, no access by vehicles or placement of goods, chemicals, fuels, soil or other materials shall take place within the fenced area. Tree protection measures shall be retained in their approved form for the duration of the work. This condition may only be fully discharged upon completion of the proposed development, subject to submission of monthly monitoring reports, detailing supervision activity - as stated in ACD Environmental's "Arboricultural Impact Assessment & Method Statement" (reference MILL21068aia-ams, revision D dated 30.4.18), submitted as part of the original reserved matters approval RM/17/81628 - and inspections of tree protection measures. Reason: to retain and protect the existing trees which form an important part of the amenity of the locality.
  23. Any windows or door marked as obscure glazed shall be permanently maintained in that condition, with the obscure glazed annotation applying to all glazing within the window opening. Where a window is also marked as non-opening, this shall mean that the window shall be fixed shut or designed so that any opening part of the window is top hung only, and the windows shall be permanently maintained in that condition. Reason: To protect the amenity and privacy of the adjoining residential property.
  24. Notes to Applicant: The proposed two-bedroomed properties on Plots 183 & 184 (Denton House Type) must be marketed/sold/leased and occupied as two-bedroomed properties only. The proposed "study" for these properties should not be used as a bedroom. The proposed three-bedroom properties on Plots 174, 175 & 186 (Portwood House Type); Plots 124, 130, 132, 142, 167 & 182 (Fordwood House Type) must be marketed/sold/leased and occupied as three-bedroomed properties only. The proposed “study” for these properties should not be used as a bedroom. Under the Town and Country Planning England Regulations 2012, a fee is required for Discharge of Condition Applications. N.B. Conditions not fully discharged, invalidate the planning permission. The development hereby permitted shall comply with the conditions imposed on the grant of the outline planning permission reference O/15/75953, as amended by X/19/84943. Whilst details of a proposed LEAP were submitted as part of the application (Drawing MILL21068-21 rev B), they were not considered to be acceptable and revised details will need to be submitted in accordance with the S106 associated with outline permission O/15/75953. In order to avoid any future excavation within the SUDS infrastructure, all Southern Water apparatus should be kept outside any impermeable membrane, with the only exception of ducted service pipes. A continuous 1.5m minimum width service strip, with “traditional” sub-base, should be provided at least at one side of the street. Horizontal clearance with structures and other utilities should be provided as per NJUG guidelines. The staggered barriers proposed for installation on Botley Footpath 1 will require consent from Hampshire County Council as Highway Authority. All proposed works to the surface of Botley Footpath 1 will require the consent of Hampshire County Council (HCC). For the avoidance of doubt, any changes to the surface of Botley Footpath 1 not included within a S38 agreement with HCC Highways Department will require consent from HCC Countryside Service. In accordance with paragraph 39 of the National Planning Policy Framework (December 2024), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
