Decision & conditions

Planning conditions
  1. REFUSE: 1no. Oak (T1) - Overall crown reduction by 1-2m on the top and 2-3m on the side leaving an aesthetically pleasing shape, crown lift to 5m above ground level, remove lowest limb over hanging over 21 Tuscan walk.
  2. Reason: The proposed overall crown reduction by 1-2m on the top and 2-3m on the side, crown lift to 5m above ground level, removal lowest limb over hanging over 21 Tuscan walk on 1 no. Oak (T1) is considered excessive and not justified and will be of detriment to the tree. The proposed works overlap with the previous proposal under application T/26/101220 (the permitted crown lift to 5m will include removal of the limb/part of the limb growing towards number 21 Tuscan Walk to provide an adequate vertical clearance and does not require a separate permission). Specification of the previously granted permission is sufficient to maintain the tree in its environment without having an impact on its health and amenity whereas the new specification includes reduction in height and overall spread which will affect the public amenity of the tree significantly and leave large diameter wounds which could compromise the tree’s long-term health and vitality without any reasonable justification.
