Decision & conditions

Part Consent Part Refuse Trees
T_25_99477 PL_Final Decision
Planning conditions
  1. REFUSE: 6no. Chestnut (T1, T2, T3, T4, T5 & T6, originating from EBC land beyond rear boundary) - Pruning of branches back to tree stump so that the branches do not fall onto the property boundary. Reason for refusal: The sweet chestnuts (T1-6) are woodland edge trees which are visible to the public from Beechwood Rise. The proposal to remove all overhang back to the boundary would leave the trees bare on one side, adversely impacting on public views of the woodland. No evidence has been supplied that would demonstrate that any are at foreseeable risk of failure into the garden. The resulting impact to tree health and public, visual amenity has therefore not been justified.
  2. CONSENT TO: 6no. Chestnut (T1, T2, T3, T4, T5 & T6, originating from EBC land beyond rear boundary) - Crownlift to 5m above ground level over the gardens of 3 and 4 Beechwood Rise.
  3. The tree works hereby consented shall be completed within 2 years of the date of this permission and shall be carried out in accordance with the approved details and to British Standard for Tree Work BS3998:2010. Reason: To ensure consented works are carried out in accordance with good arboricultural practice.
  4. Notes to Applicant: All works hereby consented should be carried out by a suitably qualified and insured tree surgeon. A copy of the decision notice should be given to the Tree Surgeon. Deadwood may be removed at any time without an application. Please be advised that the Wildlife and Countryside Act 1981 as amended, the Countryside and Rights of Way Act 2000 and the Conservation (Natural Habitats) Regulations 1994 protect ALL wild birds, their nests (whether in use or being built) and eggs and other wild animals including bats and their roosts in or adjacent to trees. The granting of consent does not give the applicant or their agent a legal right to enter land without the owner’s permission.
