REFUSE:1no. Mixed Species Group - Prune back the overhanging trees to the edge of the path by 3m. Opposite 2,3 and 4 Ripon Court.
REASON FOR REFUSAL: 1. The tree group opposite 2,3 and 4 Ripon Court comprises most of oak and ash. These are native, large and long-lived trees which make a positive contribution to the appearance and character of the area. The proposed pruning is contrary to good arboricultural practice as it would remove substantial proportions of individual tree crowns and would leave large stubs which would be likely to become colonised by decay organisms and pathogens. The reason put forward for the work is that the trees shed acorns, twigs and foliage. This does not justify work to this extent. Lesser works will be consented (see below).
CONSENT TO: 1no. Mixed Species Group opposite 2,3 and 4 Ripon Court – Lateral reduction of 1-2m on south side of the crowns only to suitable growth points. Pruning wound size will be limited to 50mm diameter.
The tree works hereby consented shall be completed within 2 years of the date of this permission and shall be carried out in accordance with the approved details and to British Standard for Tree Work BS3998:2010. Reason: To ensure consented works are carried out in accordance with good arboricultural practice.
Notes to applicant: All works hereby consented should be carried out by a suitably qualified and insured tree surgeon. A copy of the decision notice should be given to the Tree Surgeon. Please be advised that the Wildlife and Countryside Act 1981 as amended, the Countryside and Rights of Way Act 2000 and the Conservation (Natural Habitats) Regulations 1994 protect ALL wild birds, their nests (whether in use or being built) and eggs and other wild animals including bats and their roosts in or adjacent to trees. The granting of consent does not give the applicant or their agent a legal right to enter land without the owner’s permission. Advice regarding overhead utilities should be sought with the relevant service provider prior to commencing works.
