- REFUSE: 1no. Beech - Remove to prevent damage to the back fence of 77 Elliot Rise, SO30 2RW.
- Reason for refusal: The Council has taken into consideration the appeal decision made under TPO application ref: T/22/92244. Little has changed since that appeal was dismissed. The application ash (not beech as per the proposal) is an early-mature, native tree which is clearly visible to the public from Shamblehurst Lane South. It makes a positive contribution to the character and appearance of the area. As such, the reason to fell must be compelling. Little weight can be given to a tree making contact with a light structure such as a fence. Fences can be adapted to allow for the presence of growing trees. No consideration to this has been given in the application. No further justification to fell the tree has been provided. As such, this application has been refused consent.
