Decision & conditions

Planning conditions
  1. The development hereby permitted shall be implemented in accordance with the following plans numbered: LP, S01, S02, S03, P01 Rev A, P02 Rev A, and P03 Rev A. Reason: For the avoidance of doubt and in the interests of proper planning.
  2. The development hereby permitted shall start no later than three years from the date of this decision. Reason: To comply with Section 91 of the Town and Country Planning Act 1990.
  3. The materials to be used in the construction of the external surfaces of the development hereby permitted shall match in type, colour and texture those used on the existing building or otherwise be in accordance with those in the Application Form. Reason: To ensure a satisfactory visual relationship between the new development and the existing.
  4. The first-floor window in the side elevation serving the dressing room shall be obscure glazed to a minimum of Pilkington Level 3 or equivalent, with any opening parts positioned at least 1.7 metres above the internal floor level of the room. Reason: To protect the amenity and privacy of the adjoining residential properties.
  5. Note to Applicant: The applicant is advised to implement the biodiversity enhancement measures recommended within the Preliminary Ecological Appraisal by CC Ecology (August 2026), including provision for bats and swifts, areas of unmown/native wildflower vegetation, native fruiting shrubs and provision of a compost heap and log pile. The measures should be appropriately located and retained thereafter in order to provide biodiversity enhancement in accordance with Policy DM11 of the Eastleigh Borough Local Plan and the relevant provisions of the NPPF.
  6. Note to Applicant: In the unlikely event of any bats being found during demolition or construction, all work must stop immediately, and Natural England must be informed. Additional information is available on the Bat Conservation Trust website at https://www.bats.org.uk/advice/im-working-on-a-building-with-bats/ive-found-a-bat-during-works.
  7. Note to Applicant: Any vegetation clearance should be undertaken outside the main bird nesting season (generally March to August inclusive). Where this is not possible, vegetation should be checked by a suitably qualified ecologist immediately prior to clearance. If an active nest is identified, works within the affected area should cease until the young have fledged and the nest is no longer in use.
  8. Note to Applicant: Any open excavations, trenches or pipes should be covered overnight or provided with a suitable means of escape for small animals. Any wildlife encountered should be allowed to move away safely and should not be unnecessarily handled.
  9. Note to Applicant: Any new or altered external lighting should be designed and positioned to minimise impacts upon bats and other nocturnal wildlife and should follow the recommendations contained within the submitted ecological assessment and relevant guidance on bats and artificial lighting.
  10. Note to Applicant: It is requested that the building works are carried out considerately to minimise disruption to the occupiers of the neighbouring properties. The council operates a code of best practice, which is available on the council's website www.eastleigh.gov.uk by following the links to Planning and Building, Building Control, then select 'Considerate Builders Advice Note'.
  11. Note to Applicant: In accordance with Policy DM3(1)(a) of the National Planning Policy Framework (August 2026), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
