Decision & conditions

Permit
H_25_99894 PL_Final Decision (1)
Planning conditions
  1. The development hereby permitted shall be implemented in accordance with the following plans numbered: Location Plan, C25-016-001, C25-016-101 Reason: For the avoidance of doubt and in the interests of proper planning.
  2. The development hereby permitted shall start no later than three years from the date of this decision. Reason: To comply with Section 91 of the Town and Country Planning Act 1990.
  3. The materials to be used must match as closely as possible, in type, colour and texture those listed in the 'Materials' section of the application form. Reason: To ensure a satisfactory visual relationship of the new development to the existing.
  4. The first floor window on the south-west elevation [as marked on the approved plan numbered C25-016-101 rev A], shall be obscure glazed to Pilkingtons level 3 or equivalent with no more than a top opening toplight, which is positioned at least 1.7 metres above the floor of the room in which it is installed. Once installed the window shall be permanently maintained in that condition. Reason: To protect the amenity and privacy of the adjoining residential properties.
  5. Note to Applicant: In the unlikely event of any bats being found during demolition or construction, all work must stop immediately, and Natural England must be informed. Additional information is available on the Bat Conservation Trust website at https://www.bats.org.uk/advice/im-working-on-a-building-with-bats/ive-found-a-bat-during-works.
  6. Note to Applicant: Any vegetation to be removed to facilitate the development must be removed outside of bird nesting season (which is usually between the beginning of March and the end of August). If this is not possible then vegetation can be cleared only after being checked for nesting birds by a suitably qualified ecologist up to 24 hours before the start of works. If any active nests are found, work must stop, and a 5 m buffer must be erected around the nest to protect it from disturbance until after the birds have fledged and left the nest.
  7. Note to Applicant: A precautionary working method must be used to prevent harm to wildlife that could be using this site. It should include: - All building materials to be stored on hard standing or on pallets, as far as possible from hedgerows, scrub or potential habitat. - Any excavations must be covered at night or be fitted with a small animal escape ramp. - No fires can be lit on site. - Waste must be stored in a skip and not be allowed to accumulate in piles which could be used by wildlife. The pile of rubble and any piles of vegetation on site must be dismantled by hand to ensure that any animals using them for shelter have time to escape. - Any chemicals and fuels must be stored carefully and away from potential wildlife habitat. Any animals found on site should not be handled but be allowed to move away to a place of safety on their own.
  8. Note to Applicant: Biodiversity enhancements are required in accordance with Local Plan policy DM 11 and NPPF paragraphs 187d and 192 b, and are recommended in the form of a bat box or a swift nest box. The Bat Conservation Trust recommends installing a bat brick/box at least 4 m above the ground, away from artificial light sources, sheltered from strong winds and exposed to the sun for part of the day, facing south, south-east or south-west. Swift nest boxes are best positioned under the eaves or on walls facing north, northeast or north-west out of direct sunlight, five metres above the ground, with clear adjacent airspace so swifts can access them in a high-speed direct flight.
  9. Note to Applicant: As outlined in the consultation response from Southern Water (dated 19/08/2025) their records indicate that the proposed development would be built over or within 3m of a public sewer. An investigation of the sewer is required to confirm its size and depth, ascertain its condition, number of properties served and potential means of access before any decision can be made as to whether it would be acceptable. If the sewer in question is found to be no greater than 225mm in diameter and no deeper than 3 meters, the development may be allowed, subject to the following conditions: 1. No construction works parallel to the sewer within 500mm (in plan). 2. Where within three metres, foundations depth to be taken down 150mm below the invert level of the sewer. The works will be subject to approval under the 'Declaration of Works' self-certification process. Building over a “public sewer” is not normally permitted by Southern Water, however, under certain circumstances building over a minor sewer may be allowed. The conditions and application associated with the build-over/close-to a public sewer are available at Southern Water's Get Connected service: https://developerservices.southernwater.co.uk. Prior to the commencement of development, the applicant must advise the local authority, in consultation with Southern Water, of measures which will be undertaken to protect the public sewers
  10. Note to Applicant: In accordance with paragraph 39 of the National Planning Policy Framework (December 2024), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
