Decision & conditions

Permit
H_24_97888 Decision notice informative leaflet - PERMIT H_24_97888 PL_Final Decision
Planning conditions
  1. The development hereby permitted shall be implemented in accordance with the following plans numbered: PL/01, PL/02, and PL/03. Reason: For the avoidance of doubt and in the interests of proper planning.
  2. The development hereby permitted shall start no later than three years from the date of this decision. Reason: To comply with Section 91 of the Town and Country Planning Act 1990.
  3. The materials to be used in the construction of the external surfaces of the development hereby permitted shall match in type, colour and texture those used on the existing building or otherwise be in accordance with those in the Application Form. Reason: To ensure a satisfactory visual relationship between the new development and the existing.
  4. No development shall start until a Biodiversity Enhancement and Management Plan (BEMP) has been submitted to and approved in writing by the Local Planning Authority. The BEMP shall include detailed mitigation measures and precautionary working method for nesting, foraging and breeding birds. Reason: To protect and enhance biodiversity.
  5. Note to Applicant: Three bat activity surveys are required to inform a European Protected Species (EPS) license. The surveys must be done at least three weeks apart during the active bat season (May-August) in the same season as the license application. The license can only be applied for after planning permission has been granted.
  6. Note to Applicant: The applicants are reminded that the precautionary working methods recommended in the report are to avoid harm to any protected and notable species which might be sheltering under the log piles, brash and rubble. Any works to the house in advance of the three required surveys and the EPS bat license and which affect the potential bat roost features identified in this report is against the law and will be considered as a wildlife crime.
  7. Note to Applicant: It is requested that the building works are carried out considerately to minimise disruption to the occupiers of the neighbouring properties. The council operates a code of best practice, which is available on the council's website www.eastleigh.gov.uk by following the links to Planning and Building, Building Control, then select 'Considerate Builders Advice Note'.
  8. Note to Applicant: In accordance with paragraph 38 of the National Planning Policy Framework (December 2023), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
