Decision & conditions

Part Allowed at Appeal
APPEAL DECISION 3354988 H_24_97589 PL_Final Decision
Planning conditions
  1. The proposed rear extension, combined with the roof alteration, due to their combined size, mass, and scale, would be to the detriment of the modest original bungalow, disrupting the established pattern of development along Freegrounds Road, and result in unacceptable harm to the amenities of neighbouring properties. The proposal is therefore contrary to Policy DM1 of the Eastleigh Borough Local Plan (2016-2036), Quality Places SPD (2011), and the contents of the National Planning Policy Framework (2023).
  2. The proposed summer house, due to its excessive size, scale, height and position, is considered overbearing and visually intrusive. It would result in unacceptable impacts on the visual amenity of the surrounding area, particularly when viewed from Cortina Way. The proposal is therefore contrary to Policy DM1 of the Eastleigh Borough Local Plan (2016-2036), Quality Places SPD (2011), and the contents of the National Planning Policy Framework (2023).
  3. Note to Applicant: The application was refused following the assessment of the following plans: 100, 101, 102 and 103. In accordance with paragraph 38 of the National Planning Policy Framework (December 2023), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
  4. Appeal Conditions 1) The development hereby permitted shall begin not later than 3 years from the date of this decision. 2) The materials to be used in the construction of the external surfaces of the rear extension and roof alterations hereby permitted shall match those used in the existing building. 3) The development hereby permitted shall be carried out in accordance with the following approved plans, in-so-far as they relate to the proposed rear extension and roof alterations hereby permitted: Drawing Nos: 100, 101 and 102.
