Planning conditions
  1. The proposed development due to its design, massing and siting would create a visually dominant and incongruous feature at odds with the character and appearance of dwelling, neighbouring properties and the pattern of development within Botley Road. As such the development is contrary to Policy DM1 of the Eastleigh Borough Local Plan [2016-2036], provisions within The National Planning Policy Framework and the Council's Quality Places Supplementary Planning Document.
  2. Note to Applicant: The application was refused following the assessment of the following plans: D01 Rev C, D02 Rev C, D03 Rev C, D04 Rev A, D05, 900 Rev A, 901, 902 and 903 In accordance with paragraph 38 of the National Planning Policy Framework (July 2021), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
  3. APPEAL CONDITIONS 1) The development hereby permitted shall begin not later than 3 years from the date of this decision. 2) The development hereby permitted shall be carried out in accordance with the following approved plans: Dwg No: 900 rev A – Location and Block Plan as Existing Dwg No: D00 rev A – Location and Block Plan as Proposed Dwg No: D01 rev C – Floor Plans as Proposed Dwg No: D02 rev C – Elevations as Proposed Dwg No: D03 rev C – Sections as Proposed Dwg No: D04 rev A – Street Scene as Existing/Proposed Dwg No: D05 – Roof Plan as Proposed 3) The materials to be used in the construction of the external surfaces of the development hereby permitted shall match those used in the existing building unless otherwise agreed in writing with the local planning authority. 4) The development hereby permitted shall not be occupied until the windows in the side elevations at the upper floor level have been fitted with obscured glazing. No part of those windows that are less than 1.7 metres above the floor of the room in which it is installed shall be capable of being opened. Details of the type of obscured glazing shall be submitted to and approved in writing by the local planning authority before the window is installed. Once installed the obscured glazing shall be retained thereafter.
