Decision & conditions

Permit

Planning conditions
  1. The development hereby permitted shall be implemented in accordance with the following plans numbered: 01, 1545.20.02 Rev A, LOC 01 and SITE 01 Reason: For the avoidance of doubt and in the interests of proper planning.
  2. The garage hereby permitted shall only be used in conjunction with the existing dwelling and shall not, at any time, be used for business, commercial or industrial purposes or as an independent residential unit. Reason: To protect the amenity of the adjoining residential properties.
  3. The development hereby permitted shall be implemented in full with the recommended ecological and arboricultural mitigations and recommendations as outlined in the Mitigation Letter by Arbor-Eco Consultancy received 20 July 2023. This will include the installation of two water butts, planting of pollinating plants and tree remedial works. Reason: In the interest of amenity and to protect and enhance landscape character
  4. Note to Applicant: This decision is made in accordance with Section 73A of the Town and Country Planning Act 1990 (as amended), which allows for the granting of planning permission for development that has been commenced and/or been completed.
  5. Note to Applicant: Himalayan Balsam is close to your boundary. If the plant does appear on site, it should be pulled out at the roots before flowering and seeding, as the seed pods are explosive when touched and the seeds spread very easily.
  6. Note to Applicant: Southern Water Services are prepared to grant conditional approval to build near the public sewer at this address, subject to you complying with the following conditions: 1. No new structure (footings, walls etc) running within 500mm from the existing public 150mm foul sewer/manhole will be permitted. 2. Where within 3.00 metres of the public sewer, foundations must be taken to a minimum of 150mm below the invert level of the sewer/manhole. The depth of the sewer is approximately 1.25m below ground level at the time of survey. 3. Any new connections to the public sewerage system will require a New Sewer Connection application (we sometimes refer to this as a Section 106) to be submitted and approved by Southern Water. 4. Care must be taken when working in the public sewer pipeline so that no damage is caused, as any damage will be repaired at the client’s expense.
  7. Note to Applicant: In accordance with paragraph 38 of the National Planning Policy Framework (July 2021), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
