The development hereby permitted shall be implemented in accordance with the following plans numbered: 02353 Rev A, 02354 Rev A, 02355 Rev A, 02356 Rev B, 02357 Rev B, 02358 Rev B and 02359 Rev B Reason: For the avoidance of doubt and in the interests of proper planning.
The development hereby permitted shall start no later than three years from the date of this decision. Reason: To comply with Section 91 of the Town and Country Planning Act 1990.
The materials to be used in the construction of the external surfaces of the development hereby permitted shall match in type, colour and texture those used on the existing building. Reason: To ensure a satisfactory visual relationship between the new development and the existing.
Note to Applicant: Vegetation clearance or clearance of any structure that could support nesting birds would need to be done outside of nesting season which is between March and August inclusive. If this is not possible then a pre-works check by a suitably qualified ecologist would be required. If any active nests are found all work must stop and the nest be protected by a 5 m buffer until after the chicks have fledged and left the nest.
Note to Applicant: Biodiversity enhancements have been recommended. A bat brick/box and a swift brick/nest box may be appropriate to build into the extensions. Built in boxes do not require maintenance and cannot fall off. The Bat Conservation Trust recommends installing a bat brick/box at least 4m above the ground, away from artificial light sources, sheltered from strong winds and exposed to the sun for part of the day, facing south, south-east or south-west. (https://www.bats.org.uk › our-work › putting-up-your-box) Swift nest boxes are best positioned under the eaves or on walls facing north, northeast or north-west out of direct sunlight, five metres above the ground, with clear adjacent airspace so swifts can access them in a high-speed direct flight. Note to Applicant: This planning permission does not convey the right for the development to encroach over, under or on land which is not within your ownership, without the consent of the landowner
Note to Applicant: You are reminded of your duties under the Party Wall Act 1996. This requires a building owner to notify and obtain formal agreement from adjoining occupier(s) where the building owner intends to carry out work which involves: 1. Work involving an existing shared wall with another property; 2. Building on the boundary with a neighbouring property; 3. Excavating near a neighbouring building, and that work falls within the scope of the Act. Procedures under this Act are separate from the need for planning permission and building regulations approval. ‘The Party Wall etc. Act 1996: explanatory booklet’ is available at www.communites.gov.uk
Note to Applicant: The developer must ensure that their proposal, both during construction and after completion does not: • encroach onto Network Rail land • affect the safety, operation or integrity of the company’s railway and its infrastructure • undermine its support zone • damage the company’s infrastructure • place additional load on cuttings • adversely affect any railway land or structure • over-sail or encroach upon the air-space of any Network Rail land • cause to obstruct or interfere with any works or proposed works or Network Rail development both now and in the future Network Rail strongly recommends the developer complies with the following comments and requirements to maintain the safe operation of the railway and protect Network Rail’s infrastructure.
Note to Applicant: In accordance with paragraph 38 of the National Planning Policy Framework (July 2021), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
