Decision & conditions

Refuse Planning Permission For
F_25_98926 Decision notice informative leaflet - REF REM NEW F_25_98926 PL_Final Decision
Planning conditions
  1. The proposed layout, scale and design of dwelling proposed would result in a cramped and constrained plot of a size which would not provide an appropriate quality private amenity space of a size and shape commensurate with the nature of the dwelling it is intended to serve, or a suitable setting for the dwelling, to the detriment of the amenity of future occupiers of the development and out of keeping with the prevailing character of development in the locality. The application is therefore considered to be contrary to Policy DM1 of the Eastleigh Borough Local Plan (2016-2036), as well as the Council’s ‘Quality Places’ Supplementary Planning Document and the provisions of the NPPF (Dec 2024).
  2. Insufficient information has been provided to demonstrate that the proposed dwelling and associated works would not have an adverse impact upon the existing group area TPO adjacent to the site. The proposals are therefore contrary to Policies DM1 and DM11 of the Eastleigh Borough Local Plan (2016-2036), the Council’s ‘Trees and Development’ Supplementary Planning Document and the provisions of the NPPF (Dec 2024).
  3. Insufficient information has been provided to demonstrate that the proposed dwelling and associated works would not have an adverse impact upon protected species which are known to be in the locality. The proposals are therefore contrary to Policy DM11 of the Eastleigh Borough Local Plan (2016-2036), the Council’s ‘Biodiversity’ Supplementary Planning Document and the provisions of the NPPF (Dec 2024).
  4. The application fails to provide the required mitigation to offset the impacts of the development upon the European protected Solent Complex (SPA, SAC and Ramsar sites), and New Forest National Park (SPA, SAC and Ramsar sites) from additional recreational pressure and nitrogen loading generated by the population increase and additional sewage resulting from the development. The proposal is therefore contrary to the requirements of Policies DM1, DM10 and DM11 of the Eastleigh Borough Local Plan 2016-2036, the provisions of the NPPF (Dec 2024). and the Conservation of Habitats and Species Regulations 2017.
  5. Note to Applicant: The application was refused following the assessment of the following plans: 24352/100/PL, 24352/101/PL, 24352/103/PL, 24352/104/PL, 24352/105/PL, 24352/106/PL, 24352/202/PL, 24352/300/PL & 24352/301/PL. In accordance with paragraph 38 of the National Planning Policy Framework (February 2019), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
