Planning conditions
  1. The development hereby permitted shall be implemented in accordance with the following plans numbered: 01 (Block Plan as Existing), 01-A (Site Location Plan), 200 (Proposed Day Room), 200 (Block Plan as Proposed). Reason: For the avoidance of doubt and in the interests of proper planning.
  2. The site shall not be occupied by any persons other than Gypsies and Travellers as defined by Annex B of the National Planning Policy Framework (August 2026). Reason: The proposals are allowed on the particular circumstances of the case, with the site being within designated countryside in an area not usually considered suitable for new residential development.
  3. No more than 1 mobile home kept for human habitation and 1 caravan kept for touring shall be stationed on the land at any one time. Reason: The site is not considered suitable for additional mobile homes and in the interests of amenity and highway safety.
  4. Within 3 months of the date of this decision, the proposed sewage treatment plant (Klargester BioDisc Domestic Sewage Treatment Plant) shall be installed and be fully operational. The sewage treatment plant shall thereafter be retained and maintained in full working order throughout the lifetime of the development. Reason: To provide appropriate measures for the treatment and management of sewage arising from the development and to limit the impacts of the development on the European protected Solent Complex.
  5. Any gates provided shall be set back a distance of 6.0m from the edge of the carriageway of the adjoining highway. Reason: In the interests of highway safety.
  6. The development must adhere to the provisions of the Biodiversity Net Gain Assessment (Arbtech, 11 August 2025, Issue 2) and Habitat Management and Monitoring Plan (Arbtech, 28 August 2025, Issue 2) which have been submitted to and approved by the Local Planning Authority in accordance with paragraph 14(2) of Schedule 7A of the Town and Country Planning Act 1990. The specified planting shall take place during the next planting season and, thereafter, shall be managed and maintained in accordance with the approved details for a minimum period of 30 years following completion. Reason: To ensure that the development delivers a biodiversity net gain on site in accordance with Paragraph 2, Schedule 7A of the Town and Country Planning Act 1990 and Policy DM11 of the Eastleigh Borough Local Plan 2016-2036, and to accord with the provisions of Schedule 14 of the Environment Act 2021.
  7. The existing buildings on the site that are to be retained as part of the development shall be used only for purposes that are incidental to the residential occupation of the site as permitted by this approval. Reason: In the interests of amenity and highway safety.
  8. The dayroom hereby permitted shall only be used in conjunction with the approved pitch and shall not, at any time, be used for business, commercial or industrial purposes or as an independent residential unit. Reason: In the interests of amenity and as the site is not considered suitable for subdivision.
  9. No commercial activities shall take place on the land, including the external storage of materials, and no vehicles over 3.5 tonnes shall be stationed, parked or stored on the site. Reason: In the interests of amenity and highway safety.
  10. Note to Applicant: In accordance with Policy DM3 of the National Planning Policy Framework (August 2026) Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
