Decision & conditions

Permit
F_24_96865 PL_Final Decision
Planning conditions
  1. The development hereby permitted shall be implemented in accordance with the following plans numbered: 293368-ARUP-ZZ-XX-DR-L-0102_P03, HLS6400 Rev 2, 293368-01 and E01 Reason: For the avoidance of doubt and in the interests of proper planning.
  2. The development hereby permitted shall start no later than three years from the date of this decision. Reason: To comply with Section 91 of the Town and Country Planning Act 1990.
  3. A watching brief for contamination should be followed at all times during construction works. In the event that previously unidentified contamination is found during the watching brief it must be immediately reported to the Local Planning Authority. Work shall then cease until an investigation and risk assessment, and where required a remediation scheme, has been submitted to and approved in writing by the Local Planning Authority. Where a remediation scheme is required by the Local Planning Authority, the development shall not be brought into use until a verification report for the remediation work has been submitted to and approved in writing by the Local Planning Authority. All works shall be undertaken by a competent person in accordance with best practice as outlined in BS10175:2011 and CLR11. Any gas monitoring deemed appropriate is to be in accordance with best practice as outlined in such documents as BS8576:2013, BS 8485:2015, Claire RB17 and CIRIA C665. Reason: To minimise the risk from land contamination for the safety of the property’s occupiers
  4. The submitted and approved Bat Activity Survey (R3568/c) and Lighting Impact Report & Overspill Readings (JS11/03/24) shall both be accorded to in full throughout construction and operation. Reason: To ensure suitable levels of light and to not unacceptably disturb bat activity.
  5. The proposed external lighting, as show in drawing ref: 293368-ARUP-ZZ-XX-DR-L-0102_P03 and E01, shall be constructed and maintained to remain in a downwards facing position at all times. Reason: To mitigate any adverse impact from the development on the M27 and to satisfy the reasonable requirements of road safety.
  6. The floodlighting hereby approved shall not be illuminated between the hours of 22:00 and 14:00 unless otherwise agreed in writing by the Local Planning Authority. Reason: To minimise the potential impact on the countryside and settlement gap location
  7. Note to applicant: Any excavated soils that are disposed off-site should be confirmed through a waste transfer note (or similar).
  8. Note to Applicant: Given the nature of the proposed development it is possible that a crane may be required during its construction. We would, therefore, draw the applicant’s attention to the requirement within the British Standard Code of Practice for the safe use of Cranes, for crane operators to consult the aerodrome before erecting a crane in close proximity to an aerodrome. This is explained further in Advice Note 4 – Cranes (available at https://www.aoa.org.uk/policycampaigns/ operations-safety/).
  9. Note to Applicant: In accordance with paragraph 38 of the National Planning Policy Framework (Dec 2023), Eastleigh Borough Council takes a positive approach to the handling of development proposals so as to achieve, whenever possible, a positive outcome and to ensure all proposals are dealt with in a timely manner.
