  1. The proposed change of use to a care home will increase the observed parking problems on Tilston Drive, an unadopted road with no lighting or footways, creating a potential obstruction and highway safety emergency access issue. As such the development has the potential to have a detrimental impact on highway and pedestrian safety, which is contrary to NPPF (2026) decision-making Policies TR6 (Impact & Safety), Policy DP3 (Movement & Design), P5 (Maintaining Public Safety and security) and HO9 (Specialist forms of accommodation), Dudley Local Plan Policies DLP13, DLP63, DLP65 and the Council's Parking Standards SPD (2017). Refusal Statement Informative The Local Planning Authority is aware of the requirement of Policy DM 3 of the National Planning Policy Framework 2026 to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to the principle of the use, highway and pedestrian safety and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
  2. The proposal for the change of use of 8 Tilston Drive for use as a children care home (Use Class C2) is not supported in principle as there is insufficient evidence to demonstrate that the proposed use in this location would meet a direct need for this type of supported accommodation within the Borough. The proposal is therefore contrary to decision-making policy HO9 of the NPPF (2026) and Policy DLP13 of the Dudley Local Plan (2026).
