  1. The Local Planning Authority is not satisfied, on the balance of probability, that the proposed structure would meet the statutory definition of a caravan as set out in Section 29(1) of the Caravan Sites and Control of Development Act 1960 and Section 13 of the Caravan Sites Act 1968. Whilst the submitted information demonstrates that the structure could be separated into two sections for transportation, it has failed to demonstrate, on the balance of probability, that the structure would be physically capable of being moved from one place to another when assembled, as required by Section 13(1)(b) of the Caravan Sites Act 1968. Accordingly, the lawfulness of the proposed development has not been established under Section 192 of the Town and Country Planning Act 1990 and a Certificate of Lawfulness cannot be issued.
