Planning conditions
  1. Insufficient information have been provided to demonstrate that the proposed increase in the number of children using the nursery would not be met with sufficient on-site parking causing an unacceptable level of harm to the highways safety. In the absence of this evidence, it is considered that the development would likely cause demonstrable harm to highway safety. As such, the proposal is contrary to the requirements of the National Planning Policy Framework (2026), and Policies DLP 6: Infrastructure Provision, DLP 63: The Transport Network, DLP 64: The Key Route Network, DLP 65: Transport Impacts of New Development and Appendix 7 - Parking Standards of the Dudley Local Plan (2026). Refusal Statement Informative The Local Planning Authority is aware of the requirement of Policy DM 3 of the National Planning Policy Framework 2026 to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to highway safety and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
