- The Local Planning Authority is satisfied, on the balance of probability, that the proposed use of the premises as a children's residential care home for up to four children does not constitute a material change of use for the purposes of Section 55 of the Town and Country Planning Act 1990. The existing lawful use as a residential care home for up to five adults falls within Use Class C2, and the proposed operation would continue the same residential institutional function with comparable scale, character, and pattern of occupation. In reaching this conclusion, the Local Planning Authority has had regard to the submitted plans: 000 2050 (Existing & Proposed Site Plans), 000 2100 (Existing & Proposed Plan), 000 2100 (Proposed Floor Plans), and 000 2000 (Site Location Plan). Accordingly, the proposed use remains within Use Class C2 and does not require an express grant of planning permission.
