  1. The proposed development, by reason of its scale, design and massing would result in a dominant and disproportionate addition that would not appear subservient to the original property. The flat roof design would appear incongruous and visually intrusive, failing to assimilate with the established roof form of the dwelling. As such, the proposed development is contrary to the National Planning Policy Framework (2024), Policies DLP14 and DLP39 of the Dudley Local Plan (2026) and The Residential Design Guide (2023). Refusal Statement The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, there are insurmountable technical issues relating to the design that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
