The proposed development, by virtue of its excessive scale, massing and design, would introduce an overly large and incongruous two storey addition within the rear car park area. The structure would fail to respect the proportions and established design of the existing buildings, would be out of keeping with the prevailing built form of the locality, and would conflict with the appearance of the traditional, modest brick outbuildings typically found to the rear of the retail units in this area. As a result, the proposal would fail to complement or positively contribute to the established character of the retail setting. Therefore, the development would be contrary to the good design principles contained within the NPPF, the National Design Guide, and Policy DLP 4 of the Dudley Local Plan.
The proposed development has failed to demonstrate that it would provide safe and suitable access for all users, adequate parking provision, the provision for low emission vehicles and appropriate servicing arrangements. Insufficient information has been submitted regarding existing and proposed parking demand across the wider site, cycle parking provision, the adequacy of the servicing bay, and vehicle manoeuvring within the site. Consequently, the Local Planning Authority cannot be satisfied that the development would not adversely affect highway safety, parking demand or the operation of the local centre. As such the proposed development would be contrary to the NPPF, Policies DLP 4, DLP 65 and DLP 69 of the Dudley Local Plan and the Parking Standards SPD. The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design and highway safety that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
The proposed development, by virtue of its use as a pharmaceutical storage and distribution hub (Use Class B8 with ancillary Class E(g) floorspace), would introduce a facility that does not provide retail, service or community functions that meet the day-to-day needs of local residents and would primarily operate as a logistics and distribution use serving a wider network of pharmacies. Consequently, the proposal would fail to contribute positively to the vitality, viability, role and function of the Hawne Local Centre. Furthermore, the development would occupy a substantial proportion of the servicing and parking areas associated with the Local Centre, resulting in the loss of space necessary to support the effective operation of existing centre uses. This has the potential to prejudice servicing arrangements, reduce parking availability and undermine the attractiveness and functionality of the centre for businesses, customers and visitors. As a result, the proposal would detract from the continued successful operation of the Local Centre and would fail to maintain or enhance its role as a focus for local shopping and services.. The proposal is therefore contrary to Policies DLP24 (Dudley Borough Centres) and DLP25 (Local and District Centres and Local Services) of the Dudley Local Plan and the objectives of the National Planning Policy Framework relating to the vitality and viability of centres.
