- The use of 39 The Uplands to provide care and accommodation for two children, with a maximum of three members of staff present on site would form a change of use from a dwellinghouse within use class C3 of the Use Classes Order to a residential institution within use class C2. However, as a matter of fact and degree, given the nature and quantum of care provided it is considered that a material change of use requiring planning permission would not ensue from the proposal and therefore the proposed change of use would constitute lawful development under the provisions of Section 192 of the Town and Country Planning Act 1990 (as amended).
