  1. The proposed development, by reason of its siting, scale, and massing would form an overly dominant, incongruous addition that would fail to appear subservient to the host dwelling or respond to the existing building line within the streetscene. The proposal would cause demonstrable harm to the visual amenity of the host dwelling and wider streeetscene and as such, the proposal would be contrary Policies DLP4, DLP14 and DLP39 of the Dudley Local Plan and the Residential Design Guide SPD. Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA considers that there are insurmountable technical issues relating to design that has not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
