Planning conditions
  1. The proposed BT Street Hub, by virtue of its siting, scale and appearance, would form an incongruous and visually intrusive feature that would read as street clutter within the setting of the Brierley Hill High Street Conservation Area resulting in harm to its significance. Limited justification has been provided to outweigh this harm and, as such, the proposal fails to preserve or enhance the character, distinctiveness and appearance of the Conservation Area. The proposal is therefore contrary to Sections 66(1) and 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990, the National Planning Policy Framework, Policies S6, S8 and S9 of the Development Strategy (2017), Policies ENV2, ENV3 and CPS4 of the Black Country Core Strategy, Policies 2 and 59 of the Brierley Hill Area Action Plan, Policies DLP39, DLP55, and DLP56 of the emerging Dudley Local Plan and guidance contained within the Shopfront and Advertisement SPD. INFORMATIVE The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to the impact on the Brierley Hill High Street Conservation Area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
