Planning conditions
  1. The proposed development by reason of its scale and massing would fail to assimilate with the character of the host dwelling and as such would form an overly dominant and incongruous addition. As a result, this would have a negative impact upon the host dwelling and surrounding area. Therefore, the proposed development is contrary to the National Planning Policy Framework (2024), Policies DLP14 and DLP39 of the Dudley Local Plan (2026) and The Residential Design Guide (2023).
  2. The proposed development by reasons of scale, height and nearness would cause demonstrable harm to the residential amenity of neighbouring property No. 58 Chawn Hill in terms of a breach of the 45 degree code resulting in a loss of outlook and receipt of light. As such, the proposal would be contrary to the National Planning Policy Framework (2024), Policies DLP14 and DLP39 of the Dudley Local Plan (2026) and The Residential Design Guide (2023). Refusal Statement The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, there are insurmountable technical issues relating to the design that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
