The proposed detached unit, by reason of its siting, scale, separate access arrangements and the unreasonable reliance on shared kitchen facilities for a disabled occupier, would not function as an additional HMO bedroom but would instead constitute the creation of a separate planning unit. The resulting unit would form an incongruous and inappropriate form of backland development, failing to respect the established pattern of development and residential character of Tansey Green Road. The proposal therefore represents poor design and would result in an unacceptable form of development, contrary to the National Planning Policy Framework, Policies DLP4, DLP14, DLP17, DLP39 and DLP77 of the Dudley Local Plan (2026), together with the Residential Design Guide SPD and Access for All SPD.
Insufficient information has been provided to demonstrate how the proposed disabled occupier could safely, comfortably and independently occupy the unit, including how they would access and utilise the shared kitchen facilities within the main dwelling and manage refuse disposal. In the absence of this information, the Local Planning Authority cannot be satisfied that the development would provide an appropriate standard of accommodation or meet the accessibility and inclusive design expectations for disabled residents. The proposal is therefore contrary to the National Planning Policy Framework, Policies DLP4, DLP14, DLP17, DLP39 and DLP77 of the Dudley Local Plan (2026), together with the Residential Design Guide SPD and the Access for All SPD.
The proposal would result in an unacceptable loss of privacy and increased overlooking to both the occupiers of the host property and neighbouring dwellings. The development fails to provide an appropriate standard of amenity and would materially harm the living conditions of existing and future occupiers. The proposal is therefore contrary to the National Planning Policy Framework, Policies DLP4, DLP14, DLP17, DLP39 and DLP77 of the Dudley Local Plan (2026), and the guidance contained within the Residential Design Guide SPD. Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design, occupier and neighbouring ameinty that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
