The proposed development, by virtue of its size and siting, would be sited directly adjacent to the entrance, front garden, and parking area of number 9 Chapel Street which would result in an overbearing impact upon the occupiers of the dwelling. In addition, the proposal would have an overbearing impact upon the street scene of Chapel Street causing harm to the character and appearance of the surrounding area. As such, would be contrary to the advice contained with the National Planning Policy Framework (2024), Policies DLP14 and DLP39 of the Dudley Local Plan (2026), and the advice contained within the Residential Design Guide Supplementary Planning Document (2023).
The proposed staircase and raised platform, by virtue of its height and siting, would enable views into the first-floor habitable room of number 9 Chapel Street and the rear private amenity area of number 11 Chapel Street resulting in an unacceptable harm of amenity of the occupants of the dwellings with special regard to loss of privacy. As such, would be contrary to the advice contained with the National Planning Policy Framework (2024), Policy DLP14 of the Dudley Local Plan (2026), and the advice contained within the Residential Design Guide Supplementary Planning Document (2023). Informative: The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, there are insurmountable technical issues relating to the design that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
