  1. The proposed digital advertisements, by virtue of their height, illuminated nature and visually prominent siting on a modern Street Hub structure, would appear as an intrusive and incongruous form of advertising that would introduce additional visual clutter into the setting of the Brierley Hill High Street Conservation Area. The advertisements would be harmful to the visual amenity of the area and would fail to preserve or enhance the character and appearance of the Conservation Area. As such, the proposal is contrary to Policies S9 and D12 of the Development Strategy (2017), Policies ENV2 and ENV3 of the Black Country Core Strategy, the guidance contained within the Shopfront and Advertisement SPD, Polices DLP56 and DLP89 of the emerging Dudley Local Plan and the National Planning Policy Framework. INFORMATIVE The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to the impact on the Brierley Hill High Street Conservation Area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
