The proposed repositioning of Plot 9, has resulted in a reduced rear separation distance of 13.3m to the neighbouring properties of 28 and 29 The Paddock and has an overbearing two storey flank relationship with Plot 10, which would cause unacceptable harm to the privacy, outlook and amenity of existing and future occupiers. The development therefore fails to achieve a high standard of amenity as required by the National Planning Policy Framework (2024), and is contrary to Policy DLP14 (Housing Development, Extensions and Alterations to Existing Dwellings) and Policy DLP39 (Design Quality) of the Dudley Local Plan (2026), as well as the separation distance and amenity requirements set out in the Dudley Borough Residential Design Guide SPD (2023).
The dwelling has been constructed within the Root Protection Areas of retained London Plane trees, resulting in an unsustainable relationship that is likely to lead to future pressure for pruning and potential tree loss. The submitted arboricultural information fails to demonstrate that the trees have been adequately protected or that the development accords with BS5837:2012. The proposal is therefore contrary to Policy DLP33 (Provision, Retention and Protection of Trees) of the Dudley Local Plan (2026) and the Dudley Borough Residential Design Guide SPD (2023), and paragraph 131 of the National Planning Policy Framework (2024) Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to amenity/design and impact on trees and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
