The proposed development would be located within the Root Protection Area (RPA) of the Purple Beech, which would result in unacceptable harm to the long-term health and structural integrity of the tree. The proximity of the development to the Purple Beech would likely lead to future pressure for pruning or removal. Moreover, the cumulative effect of development in close proximity to multiple high-value trees further constrains the site and reduces the scope for acceptable development without arboricultural harm. The unjustified incursion into the RPA of a protected Category A tree, combined with the likelihood of future pressure for works, fails to comply with paragraph 136 of the National Planning Policy Framework (2024), Policy S22 Dudley Borough Development Strategy, Policy DLP33 of the emerging Dudley Local Plan and British Standard 5837:2012. INFORMATIVE The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to the impact on visual amenity that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
