  1. The Local Planning Authority is not satisfied, on the balance of probability and on the basis of precise and unambiguous evidence, that a material operation as defined by Section 56(4) of the Town and Country Planning Act 1990 (as amended) was carried out prior to the expiry of planning permission P18/0186 on the 7th of February 2022. The evidence submitted does not adequately demonstrate that the excavations undertaken before that date formed part of the approved development, and inconsistencies within the additional evidence submitted significantly reduce the weight that can be afforded to it. As such, it has not been demonstrated that planning permission P18/0186 was lawfully commenced and remains extant. The Local Planning Authority is therefore not satisfied that the operations described in the application are lawful for the purposes of Section 191 of the Town and Country Planning Act 1990 (as amended), and the Certificate of Lawful Existing Development is refused.
